Avenue 33 Farm Liability Waiver & Agreement

In consideration for being allowed to visit Avenue 33 Farm and participate in its activities (collectively, “the Activity”), I release from liability and waive any right to sue Avenue 33 Farm and/or its owners, officers, employees, volunteers, partners, shareholders, successors, assignees, parents or subsidiaries entities, representatives, members, affiliates, contractors, and/or agents (collectively, “Avenue 33 Farm”) from any and all claims that may directly or indirectly result from the Activity, including liabilities, damages, losses, costs, expenses, claims, or demands (including without limitation those based on negligence, gross negligence, and/or product liability, breach of contract, or breach of any statutory or other duty of care owed under applicable laws) that I, my heirs, next of kin, spouse, distributees, guardians, legal representatives, executors, administrators, successors, and/or assigns have now or may hereafter have for any injury to me or my property.  

I am voluntarily participating in the Activity.  I understand that there are risks associated with my participation in this Activity, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death, economic loss, or property damage. These injuries or outcomes may arise from my own or other’s actions, inactions, or negligence, or the condition of the Activity location or facility. Nonetheless, I assume all risks of my participation in this Activity, whether known or unknown to me, including any events incidental to the Activity.  

I agree to hold Avenue 33 Farm harmless from any and all claims, loss or damage to my personal property, liabilities and costs, including attorney’s fees, as a result of my participation in the Activity, including any events incidental to this Activity. 

I consent to the use by Avenue 33 Farm LLC of my image, voice, name and/or story in any format, including video, print, or electronic (collectively, the “Materials”), as Avenue 33 Farm LLC may deem appropriate to promote its programs. Avenue 33 Farm LLC may make the Materials available at its discretion to third parties, on Avenue 33 Farm LLC website, in Avenue 33 Farm LLC publications, or through any other media, including social networking websites. I waive any right to inspect or approve the finished product or to receive any payment. I grant to Avenue 33 Farm LLC all copyrights in the Materials and waive any legal claims, including those relating to copyright, or rights of publicity or privacy.

I hereby affirm:  I am 18 years of age or older.  I have carefully read this document and I understand its contents. I understand the legal consequences of signing this document, including (a) releasing Avenue 33 Farm from all liability, (b) waiving my right to sue Avenue 33 Farm, (c) and assuming all risks of participating in this Activity, including any events incidental to this Activity.  I am signing this document of my own free will.  

 PARENT/GUARDIAN RELEASE: IF GUEST IS UNDER 18 YEARS OF AGE

I am the parent or legal guardian of the minor visitor and I am signing this document on his/her/their behalf.  I have read this document, and I am signing it freely. I understand the legal consequences of signing this document, including (a) releasing Avenue 33 Farm from all liability on my and the Participant’s behalf, (b) waiving my and the Participants’ right to sue Avenue 33 Farm, (c) and assuming all risks of Participant’s participation in the Activity, including any events incidental to the Activity. I allow the Participant to participate in this Activity. I understand that I am responsible for the obligations and acts of the Participant as described in this document. I agree to be bound by the terms of this document.
